My name is Prakash Kumar Chandnani and I am from Jaipur and on 31/12/21 I got several calls from Club Mahindras Representative that they got my number from Tata Motors and they have some collaboration with them and they are offering free voucher for staying 2 nights 3 days in their resort for a experience, whoever bought a Tata car.
They kept calling me and when I reached there venue around 6pm on 31/12/2021 at Park Primie Hotel, C Scheume, Jaipur at R floor, I met their sales representative Mr Vivek (Mr Shahrukh they in all hurry convinced me to join Club Mahindra membership and when I refused they gave me an option to pay Inr74, 298 for any of club mahindra or its parteners properties for staying 6nights(within April’22 validity) in any of overseas/Indian property and 10 nights in club mahindra’s any Indian properties (Lifetime validity), as promo for new membership and if my experience goes well and I might want to continue membership than this Inr74, 298/- would be treated as advance paid from full membership fees and If I don’t use their any service, company would refund full money w/in 30 days, whenever I ask to cancel membership.
They deducted Inr74, 298 from my debit card for those 16 nights payment and also in hurry made me to sign ECS mandate if I willing to go for full membership later on. Thereafter I received a message that my membership no. is 2967320 from CLUB MAHINDRA.
They did not give me any document or terms & conditions and told me that I would get it by e mail.
They told me that I can cancel this membership at anytime and I get full refund w/in 30 days and upon reaching home, same day (31st Dec21) I decided to cancel membership and I called Mr Vivek and he told me that not to cancel or I won’t get money for long time, as they need to cancel some voucher (which they never gave to me) and other team which handles refund might take several months to refund money.
*(This was not he told at the time of charging membership fee)
I checked CLUB MAHINDRA (MAHINDRA HOLIDAYS & REORTS INDIA LIMITED) website for cancellation of membership and they have very strange condition to send a signed/written application to cancel this membership w/in 10 days or they won’t refund money, which I am going to do on coming monday (03rd Jan’2022), also I am going to send them e mail to cancel my membership and refund money my money, which they have deducted.
I was not explained any such thing by their sales representative, as they said I can cancel it any time and company would refund money w/in 30 days, also their cancellation policy is unfair, which they never inform at the time of charging money and their only intention is fool people and loot people.
This is clear that company and their sales representative are misrepresenting their product and charge money towards membership w/out giving any written terms & conditions before charging money and later saying a different things (story) or sending different terms & conditions by e mail, which is not same at the time they take money and refuse to pay money for asking membership cancellation.
They are using digital sign through aadhar OTP and never show/share terms and conditions, which is only on small device and later on only send by it e mail, which is very much different than they verbally explain.
So I dont want their membership, as I was misguided and thus I want my full money Inr74, 298 immediately and they should not deduct any money for mandate given to them toward EMI or annual maintenance fees for membership.
If company doesn’t refund money w/in 30 days than I want another Inr1, 00, 00, 000/- for compensation for cheating me. As I am a Non Resident Indian and I must go overseas to my Job and not waste time/energy here, which may cause me loss of my overseas income, higher taxation on my total income being Resident in India than being NRI under Income tax act for staying more than 182 days in India, as due to lock down/flight suspension already stayed more than 5 month in India so far.

I urge consumer court to take very strong actions again CLUB MAHINDRA (MAHINDRA HOLIDAYS & RESORTS INDIA LTD) for fraud selling their products and put a hefty penalty, as court can see that their are hundreds of complaints against CLUB MAHINDRA for selling their product and services by misrepresentation and without heavily punishing them, they going to keep cheat people for coming time also.
I have recorded phone call with company’s sales representative, if needed to prove my claim.
