Dear sir
I am Col Aurobinda Halder, a serving officer of Indian Army, presently posted at Meerut, Uttar Pradesh. I am native of 171, Purbapara, Ramnagar Road, Bongaon, Dt North 24 Parganas, West Bengal 743235 and serving the nation in olive green uniform for last 27 years. In Jun 2007, I signed an agreement with Desire Agro Resort Development Pvt Ltd, a real estate company with Mr Ashoke Bose and Mr Sanjay Shaw as their Managing Director and Director respectively. The agreement was signed to purchase 2160 sq ft plot for Rs 3, 90, 000 in their project named Middletown, Bhasa near Amtala, ahead of Joka on Diamond Harbour road with a booking amount of Rs 38, 000.00( Thirty eight thousands only) and with condition that rest of the payment to be made in 48 monthly installments. I kept on making payment through cheque every month. In between, I kept interacting with Mr Ashoke Bose telephonically and met him few times during my vacation in his previous office P 85 Lake road, Kolkata 29, which was later shifted to P 525 Hemanta Mukhopadhaya Sarani or Raja Basanta Roy road, Kolkata 29. Mr Ashoke Bose resides at 23 Santoshpur west Road, South park, Kolkata 75 and has got another office at 3A South park, Santoshpur, Kolkata 75. Whenever I met him, every time he assured me that the land is in the process of development like earth filling, road infrastructure etc and the registration will be done after the development work is over. In Oct 2010, I received a letter from his office which stated that the project is facing some issues and inordinate delay was due to some legal impasse but the project is expected to be completed by 2012. In Sept 2012, I received another letter in which Mr Ashoke Bose mentioned that your plot has been relocated that registration of the land is expected to be completed before 31 Dec 2012. In the same letter he had given some other option also which I declined. Till Jun 2012 I had already paid Rs 3, 66, 000.00(Three Lakhs sixty six thousands only) to the company and I did not have any doubt in my mind till that time. Subsequently, he stopped interacting and I did not receive any official correspondence from the company. But whenever I have been meeting him during my leave period he was taking excuse of some legal impasse and kept delaying it further. I could not pursue the matter persistently due to contingency of my army service and long absence from West Bengal. I learned from the environment that State Consumer Dispute Redressal Commission can help me in this matter. I have all the documents with me and having the receipt of every transaction. I am attaching herewith some of the documents.
I sincerely seek a redressal to get the plot from the company for which I have invested my hard earned money . If the company cannot give the plot they may pl be persuaded to pay me back the money with 12 percent interest with effect from the year 2007. It is a cry from a soldier and I hope the consumer court will address it with the utmost sincerity.
